Terms of Service

These Terms of Service ("Terms") govern your use of the SOCWarden platform, including the dashboard, APIs, SDKs, agent software and documentation (collectively, the "Service"), operated by SOCWarden ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
SOCWarden is a security observability platform that provides real-time security event monitoring, threat intelligence enrichment and alerting for software applications. The Service ingests security events from your applications via our SDKs or agent, enriches them with threat intelligence from multiple sources (including GeoIP, OSINT threat feeds, IP reputation services and AI-assisted analysis) and delivers actionable alerts and risk scores through a web dashboard.
2. Account Terms
To use the Service, you must create an account and provide accurate, complete information. The following terms apply to your account:
- Each organization has a single owner who is responsible for billing, account management and compliance with these Terms.
- Organization owners may invite team members and assign roles (administrator, analyst, viewer). The owner is responsible for the actions of all team members within their organization.
- You are responsible for maintaining the security of your account credentials, including your password and API keys. API keys grant full ingest access to your organization and must be treated as secrets.
- You must notify us immediately at legal@socwarden.com if you suspect unauthorized access to your account or API keys.
- You must be at least 16 years old to create an account. Accounts registered by automated methods (bots) are not permitted.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. The following uses are prohibited:
- Using the Service to facilitate, support or conceal illegal activity.
- Submitting events or data that you do not have the legal right to collect or transmit.
- Abusing the API through excessive requests beyond your plan limits, automated scraping of the dashboard or any activity designed to degrade or disrupt the Service.
- Attempting to reverse engineer, decompile, disassemble or otherwise derive the source code of the Service (except where prohibited by applicable law).
- Reselling, sublicensing or redistributing access to the Service without prior written consent.
- Circumventing rate limits, usage quotas or other technical restrictions imposed by the Service.
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use terms.
4. Plans, Billing and Overage
SOCWarden offers the following subscription plans:
- Free: Limited event volume with 7-day data retention. No credit card required.
- Starter ($12/month): Higher event volume with 30-day data retention.
- Pro ($49/month): Increased event volume with 60-day data retention and advanced features.
- Business ($99/month): Highest event volume with 90-day data retention, priority support and full feature access.
Yearly billing is available at a discounted rate. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law.
If your event volume exceeds your plan's included allocation, you will be charged overage fees per 1,000 events at the rate specified on your plan's pricing page. Overage charges are billed at the end of each billing cycle. We will notify you when you approach your plan's event limit.
All payments are processed by Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on file for recurring subscription fees and any applicable overage charges.
5. Data Ownership
You retain all ownership rights to the security event data and other content you submit to the Service ("Customer Data"). SOCWarden does not claim ownership of your Customer Data.
By using the Service, you grant SOCWarden a limited, non-exclusive license to process, enrich, store and display your Customer Data solely for the purpose of providing the Service to you. This license terminates when your account is closed and your data is deleted in accordance with Section 8.
We may use aggregated, anonymized data derived from Customer Data (such as overall threat trends, attack pattern statistics and aggregate event volumes) to improve the Service. Such aggregated data cannot be used to identify you or your end users.
6. Service Level Agreement
For paid plans (Starter, Pro and Business), SOCWarden targets 99.9% uptime for the ingest API and dashboard, measured on a monthly basis. Uptime excludes scheduled maintenance windows, which will be announced at least 48 hours in advance.
If we fail to meet the 99.9% uptime target in a given calendar month, affected paid customers may request a service credit equal to 10% of that month's subscription fee for each full 0.1% below the target, up to a maximum of 30% of the monthly fee. Credit requests must be submitted within 30 days of the month in which the downtime occurred.
The Free plan is provided on an "as is" basis with no uptime guarantee or SLA.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOCWARDEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SOCWARDEN IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
THE SERVICE IS A SECURITY MONITORING TOOL AND IS NOT A SUBSTITUTE FOR PROFESSIONAL SECURITY ASSESSMENT, INCIDENT RESPONSE OR COMPLIANCE SERVICES. SOCWARDEN DOES NOT GUARANTEE THAT THE SERVICE WILL DETECT ALL THREATS OR PREVENT SECURITY INCIDENTS.
8. Termination
Either party may terminate these Terms at any time:
- You may terminate by canceling your subscription and deleting your account through the dashboard settings. Your access will continue until the end of your current billing period for paid plans.
- Wemay terminate or suspend your account immediately if you breach these Terms, if required by law or if we discontinue the Service with at least 90 days' notice.
Upon termination, your right to use the Service ceases immediately (or at the end of the billing period for voluntary cancellation). All Customer Data associated with your account will be permanently deleted within 30 days of account termination. You may export your data through the dashboard or API before termination.
9. Modifications to Terms
We may modify these Terms from time to time. When we make material changes, we will notify you by email or through a notice in the dashboard at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the modified Terms, you may terminate your account before the changes take effect.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
